Welcome to V Klik Technologies Pvt. Ltd. ("V Klik", "we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of our digital platform accessible at https://vklik.com and our mobile application (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you and V Klik.

2. Description of Service

V Klik is a digital marketplace platform that connects customers with content creators, including:

• Influencers for brand collaborations
• Reel editors for video editing services
• Reel shooters for content creation and filming

V Klik acts solely as a facilitator and marketplace. We are not an employer, agency, or service provider.

3. User Obligations

By using the Platform, you agree to:

• Provide accurate, complete, and up-to-date information
• Maintain the confidentiality of your account credentials
• Use the Platform only for lawful purposes
• Comply with all applicable laws and regulations
• Respect the rights of other users and third parties
• Follow booking and cancellation policies as displayed
• Refrain from any attempts to bypass the Platform

4. Bookings and Payments

• All bookings must be made through the Platform using the provided booking system
• Payments are processed securely through authorized payment gateways
• Cancellation policies vary by service type and are clearly displayed before booking
• Refunds are processed according to the applicable cancellation policy
• Service fees and pricing are as displayed on the Platform

5. Prohibited Conduct

The following activities are strictly prohibited:

• Sharing contact information (phone numbers, email addresses, social media handles) before booking completion
• Making payments outside the Platform
• Attempting to circumvent Platform fees or policies
• Providing false or misleading information
• Uploading fake portfolios or misrepresented work samples
• Harassing, threatening, or abusing other users
• Violating intellectual property rights
• Engaging in fraudulent or illegal activities

6. Account Suspension and Termination

V Klik reserves the right to suspend or terminate your account immediately and without prior notice for violations of these Terms, including but not limited to:

• Breach of prohibited conduct policies
• Anti-bypass violations
• Fraudulent activities
• Harassment of other users
• Repeated policy violations

Upon termination, your right to use the Platform ceases immediately.

7. Limitation of Liability

To the maximum extent permitted by applicable law, V Klik shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Service quality issues or unsatisfactory deliverables
• On-site disputes or interactions
• Third-party actions or negligence
• Force majeure events

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Warranties of fitness for a particular purpose
• Warranties of non-infringement
• Warranties of accuracy or reliability

We do not guarantee that the Platform will be uninterrupted, error-free, or secure.

9. Indemnification

You agree to indemnify, defend, and hold harmless V Klik, its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses arising out of or related to your use of the Platform, violation of these Terms, or infringement of any rights of another party.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to:

• Information Technology Act, 2000
• Indian Contract Act, 1872
• Consumer Protection Act, 2019

Jurisdiction: Exclusive jurisdiction shall lie with the courts in Pune, Maharashtra, India.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through:

1. Negotiation: Direct communication between parties
2. Mediation: Through a mutually agreed mediator
3. Arbitration: In accordance with the Arbitration and Conciliation Act, 1996
4. Court Proceedings: In the courts of Pune, Maharashtra

12. Anti-Bypass Policy

A. Platform Exclusivity

All transactions, communications, and service agreements must be conducted exclusively through the V Klik Platform.

B. Prohibited Actions

• Moving transactions off-platform after initial contact
• Sharing direct contact information before booking
• Negotiating services outside Platform terms
• Bypassing Platform fees or payment systems

C. Enforcement

• First Violation: Written warning and temporary account restriction
• Second Violation: Account suspension for 30 days
• Third Violation: Permanent account termination
• Severe Cases: Immediate permanent ban without prior warning

D. On-Site Liability Disclaimer

V Klik does not supervise, monitor, or participate in on-site interactions. We:

• Do not supervise physical shoots or meetings
• Do not control user behavior during on-site engagements
• Are not responsible for on-site disputes, injuries, or misconduct
• Do not provide insurance for on-site activities

Users assume full responsibility for on-site safety and conduct.
